Tour Terms & Conditions1. Explanation of Tour Terms & Conditions This Tour Terms & Conditions document represents a portion of the terms of transaction stipulated in Section 4 of Article 12 and in Section 5 of Article 12 of the Travel Agency Law.2. Contract for Agent-Organized Tours1. Responsibility rests with the company operating Agent-Organized Tours (hereinafter referred to as “GMT “) whose name in full appears below and in its tour brochures. Clients joining such tours shall conclude an Agent-Organized Tour Contract (hereinafter referred to as the “Travel Contract”) with GMT. JTB Global Marketing & Travel Inc. (GMT) Address 2-3-11 Higashi-shinagawa, Shinagawa-ku, Tokyo 140-8604 Commissioner of Japan Tourism Agency Registered Travel Agent No.17232. GMT shall arrange and manage tour arrangements and itinerary management so that the client receives tour services including transport/accommodations (hereinafter referred to as “tour services”) provided by transportation/accommodation operators during the tour itinerary set by GMT.3. The content and conditions of the Travel Contract shall conform to those speci ed in each tour itinerary, the conditions as speci ed hereunder, the nal itinerary handed to clients before departure (hereinafter referred to as the “Final Tour Itinerary”) or this brochure when Final Tour Itinerary is not applicable, and the tour contract for Agent-Organized Tours as described in GMT’s tour terms and conditions (hereinafter referred to as “Tour Terms and Conditions of Agent-Organized Tours”). 3. Application of Agent-Organized Tour Contracts and their Conclusion1. The client shall provide information on GMT’s tour contract as required by GMT and its agents (hereinafter GMT and its agents are referred as “COMPANIES”) and submit the form together with the necessary reservation deposit. The reservation deposit shall be 10 percent of the tour fare. Paid deposit shall be applied to the tour fare, cancellation charges or penalties. The Travel Contract shall be concluded upon COMPANIES’ acceptance of reservations and said deposit.2. COMPANIES may accept applications for Travel Contracts by telephone, mail, facsimile and other means of communication. In such cases, the client shall submit the application form and reservation deposit to COMPANIES within 3 days counting from the day when acceptance of application is con rmed. If the client fails to supply the required application form and deposit within 3 days, the reservation shall be voided.3. The Travel Contract shall become valid upon COMPANIES’ consent to the conclusion of the contract and receipt of the reservation deposit. If the application is made by phone, the Travel Contract shall become valid upon COMPANIES’ acceptance of the tour deposit as specified in the Clause 2. When the application is made by mail, facsimile or other communication methods, the Travel Contract shall become valid upon payment of the Tour Deposit and COMPANIES’ noti cation of acceptance of the Travel Contract. The Travel Contract shall conform to Clause 3 of Article 23 for conclusion of contract even when the tour is applied for by telephone, mail, facsimile, and other means of communication. 4. When applying for group tour arrangements (more than 2 people), the Travel Contract including conclusion and cancellation of the contract shall be exchanged between COMPANIES and the group representative.5. The group representative responsible for the contract shall provide COMPANIES with the name list of members by the date speci ed by COMPANIES.6. COMPANIES shall not be responsible for any liabilities or obligations the group representative holds in the past or in the future.7. In case the group representative does not accompany the group, COMPANIES shall consider one of the members who have been selected by the representative as the group representative who is responsible for the contract after tour starting day.8. If the Travel Contract cannot be finalized due to full occupancy in seats or rooms or other reasons at booking, COMPANIES may ask the client to wait until the speci ed date with his/her consent.(This booking status shall be referred as “ waiting ” hereinafter.) In this case, the client shall be registered as “waiting client” and COMPANIES shall make an effort to make it bookable. Even in this case, COMPANIES shall charge the client the reservation deposit (“Waiting” does not guarantee con rmation of booking). However, if the client requests COMPANIES to release the waiting, or if the booking is not con rmed until the speci ed day, GMT shall return a full of the reservation deposit.9. Even in case of the Clause 8, the Travel Contract shall be nalized at the day when COMPANIES inform the client of the con rmation.4. Conditions of Tour Application1. A client under 20 years of age traveling alone during the tour period shall provide GMT with the written consent of his/her guardian. Clients under 15 years of age must be accompanied by a parent or guardian.2. GMT may refuse an application if any one of the client’s age, quali cations, skills or other conditions does not conform to those designated for tours aimed at speci c customer categories or purposes.3. GMT may decline the application of crime syndicates, clients who are members of or involved with crime syndicates, and clients who are involved in other socially destructive behavior. 4 GMT may refuse participation of clients who make violent or unreasonable demands to COMPANIES, or use threatening or violent behavior in regard to the transaction.5. GMT may refuse participation of clients who attempt to damage the reputation of COMPANIES through use of fraudulent means or force, circulation of rumors, or attempt to obstruct business in other ways.6. Clients who require special attention from GMT during the tour for reason of chronic disease, general ill health, pregnancy or physical handicap, shall advise GMT of this when applying for the tour. GMT shall comply with such requests to the extent deemed feasible and reasonable. And if GMT takes a special arrangement in compliance with the client’s request, the client shall be responsible for incurred expenses related with the request. GMT may require clients to present a medical certi cate. GMT may refuse a client’s application if conditions at travel destinations and facilities are such that safe, smooth tour operation cannot be guaranteed, or require the client to be accompanied by an escort. In some cases, GMT shall change a part of the itinerary or recommend the client to join another tour with the minimum extra charge or refuse his/her participating the tour. 7. For Clauses 1, 2, and 6, GMT shall contact the client when necessary in principle, within one week after the application is submitted for Clauses 1 and 2, and the advice is presented for Clause 6.8. If GMT determines that the client needs medical diagnosis or treatment by a physician owing to illness, functional disease or other reasons during the tour, GMT shall take measures necessary to ensure smooth operation of the tour. All costs resulting from such measures shall be borne by the client.9. Independent activities for reasons of the client’s own choosing shall not be arranged by GMT during the tour. However, GMT may, depending on the tour course, arrange such activities under separate conditions.10. GMT may refuse client participation if it determines that he or she threatens to embarrass, inconvenience or interfere with the collective activities of tour participants.11. GMT may also refuse client participation for the tour operation reasons.5. Contract Document and Final Tour Itinerary1. After the client has entered into a Travel Contract with COMPANIES as stipulated in Articles 2 & 3 above, the brochures and the tour conditions listed herein shall be included in the Travel Contract.2. Unless speci ed in the Travel Contract, GMT shall submit a written contract stating tour itinerary, details of the services, other tour conditions and GMT responsibility to the clients, no later that one day prior to tour departure date. Irrespective of the above, when application for the Agent-Organized Tour is made on or after 7 days prior to the eve of tour departure, the Final Tour Itinerary shall be presented to the client by the departure date. The tour brochure may become the nalized itinerary for the tour in some cases.3. The scope of travel services for which GMT is liable in arranging and administering the itinerary shall be speci ed in the Travel Contract as stated in Clause 1 and in the Final Tour Itinerary as stipulated in Clause 2 hereinbefore. 6. Payment of Tour FareThe Tour Fare shall be paid no later than the 13th day prior to the eve of the departure date. When application is made on or after the 13th day prior to the eve of the day the tour starts, the tour fare shall be paid before departure by a date designated by COMPANIES. Even when the client and GMT do not enter into the correspondence contract stipulated in Article 23, if the client is a member of COMPANIES af liated credit company and consents to pay for the itinerary by credit card, GMT shall charge the client’s credit card for tour fares (inclusive of tour deposits and additional charges), any cancellation charge or non-ful llment fee stipulated in Article 14, additional charge as stipulated in Article 10 and handling fees stipulated in Article 13 even without a signature. In the absence of any request from the client, the card will be charged on the date the client accepts the itinerary.7. Tour Fare1. Clients 12 years of age or more shall be charged adult fare and those aged 6 to 11 shall be charged child fare unless otherwise speci ed. However, when a tour includes air travel, clients aged 3 to 5 will be charged child fare. One child ve years of age or less can join the tour in GMT of an adult, but will receive no services such as meals or bed. If more than one child, one child fare will be charged for each additional child ve years of age or less. This does not apply to tours for which infant fares are quoted. 2. The fare is indicated for each tour course. Clients are asked to con rm the fare according to the departure date and the number of participants.3. The Tour Fare shall be the basis for calculating the cancellation charge (Article 14) and amount of compensation for changes (Article 22). The “Tour Fare” on the advertisements or brochures will be calculated as follows: tour fare “(+)” additional “(-)” reduction.8.Services Included in the Tour FareThe following may include items unrelated to the tours you choose. Please note that the items included the tour fare are only those speci ed in the itinerary.In principle, GMT will not make refunds for the below services even if clients choose not to use the relevant services.Hotel RoomsRooms with private shower on a twin room basis (two-in-a-room) at the hotels speci ed in each itinerary except in cases when stated as otherwise on the tour itinerary. A client traveling alone is requested to book a single room for tours including accommodations. For single room occupancy by choice or circumstances, extra charges will be required as shown in the respective column in each itinerary. Triple room may be provided as a twin room with one extra bed added.MealsMeals will be served as speci ed in each itinerary.Railways (JR Shinkansen)Tours listing First class shall be conducted by Green Car. Other categories shall be operated by tourist class. JR Other Limited ExpressWhen used in our tours, tourist class reserved seats shall be provided.Other RailwaysWhen operated by subway or local trains, no reserved seats shall be provided. In the case we use Limited Express, tourist class reserved seats shall be provided unless speci ed as a non-reserved seat.Sightseeing& ExcursionsBy sedan, van, taxi, motorcoach and/or sightseeing boat on a seat-sharing basis, plus admission fees to temples, shrines, museums, etc mentioned in each itinerary. A minibus, sedan or taxi may be used when the total number of participants is limited. Seat-sharing sightseeing tours for Japanese tourists are used for some tours.TransfersTransfers shall be conducted by motorcoach. A sedan, van or taxi may be used if the total number of participants is small.BaggageThe transfer and handing of one piece of normal sized baggage (up to 50cm x 60cm x 120cm) per person, including redcap fees, where speci ed in the itinerary. However, at certain times and places this service is not included owing to limited baggage capacity on trains and/or ships and the unavailability of porters at stations, hotels and/or airports.Guide ServicesEnglish-speaking guide and assistant service shall be provided as listed under the “Guide Service” column for each tour.GratuitiesGratuities to hotel workers, porters and chauffeurs are included in the tour fare.TaxConsumption tax is included in the price of the tour. AirlinesEconomy-class seats for tours which include domestic ights.9. Services Not Included in the Tour FareCharges and expenses other than those speci ed in the preceding Article 8, such as:1. Laundry, telephone, additional meals and drinks, and any other expenses of personal nature.2. Airport departure taxes.3. Excess baggage.4. Tour fares for optional tours requested by customers (short trips incurring an additional fee). 5. Medical expenses for injuries and illness.6. Travel and accommodation costs between arrival/departure and the start and end points of the itinerary.10. Additional FaresThe additional fares are required for following arrangements1. Additional charges for “Upgrade Plans” to upgraded hotels or class of room.2. Additional charges for changing from a “Plan Without Meals” to a “Plan With Meals”3. Additional charges for “Hotel Extension Plan” to extend the staying period4. Surcharges to upgrade airline classes5. Other additional charges as speci ed in brochures and other material.11. Revision of Travel Service ContentGMT may, after conclusion of the Travel Contract, revise its contents and services for any of the following reasons: natural calamity or disaster, civil unrest, suspension of services rendered by transport/accommodation facilities, provision of transportation not based on the original operational plan, governmental orders, or other circumstances beyond GMT control. GMT reserves the right to take necessary measures when safe, smooth tour operation in accordance with the itinerary is deemed impossible, or when there is valid reason to believe that the tour cannot continue. In such cases, GMT must explain in a timely manner its inability to function according to the Travel Contract under the circumstances. However, said explanation may be made after revisions are made when conditions demand.12. Change of Tour FareGMT shall not make any change to the tour fare, supplemental charges, or discount rates after the conclusion of a tour contract, except in the following cases:1. GMT may revise its schedule of fees in accordance with increases or reductions of transport costs and/or charges for Agent-Organized Tours as a result of unusual or unforeseen economic developments. In such cases, GMT shall notify the client of these changes no later than the 15th day prior to the eve of departure. 2. GMT shall, when transportation fares or charges stipulated in Clause 1 are substantially reduced, reduce the tour fare as stipulated in Clause 1. 3. GMT shall, when tour contents are revised and results in the reduction of necessary tour operation costs, reduce the tour fare accordingly.4. GMT shall, when tour operation costs (including cancellation charges, penalties, and other expenses for tour services unavailable due to the revision of contract content, which clients have already paid or bear obligation to pay) have risen due to one of the reasons stipulated in Section 11 above, revise the tour fare accordingly. However, in the case that substitutions are required because of a shortage of facilities, transportation seats, hotel rooms, etc., though such services are available, this paragraph will not apply.5. In the case that tour brochures read that tour fares shall differ depending on the number of users of transportation/ accommodation, GMT shall adjust the tour fare to the degree described in the tour contracts when the number of tour participants change.13. Change of Tour ParticipantsA client who has entered into a Travel Contract may, with GMT’s consent, transfer the status in the contract to a third party. In this case, the clients shall enter the required information in the form provided by GMT and submit it together with the speci ed handling fee. The transfer of status in the contract to a third party shall become valid by the consent of GMT. GMT may reject a change in the name of travelers if transportation or accommodation operator does not accept the change or for any other reason.14. Cancellation Rates1. If a client cancels the Travel Contract for personal reasons, the following cancellation rates will apply to the tour fare. Clients remaining in the tour will incur the balance of additional per room costs associated with the change in number of participants.
